Immigrant language-learning bonus flops



The government’s offer of performance-based bonuses to immigrants who learn Swedish in under a year has failed to produce results, according to a new report.

Bonuses of up to 12,000 kronor ($1,900) seem not to have been incentive enough for students in Swedish for Immigrants (Svenska för Invandrare – SFI) courses, as less than a fifth of the government’s money has been spent, Sveriges Television (SVT) reports.

“I had hoped that more would have received the bonus to allow integration,” said integration minister Erik Ullenhag to The Local.

The concept of rewarding quicker completion of language studies has benefited approximately 2,000 students since its introduction last year.

However, only 18.5 million of an allocated 100 million kronor has been spent.

The reform was put in place to encourage a more efficient way of learning Swedish and to make integration into Swedish society easier, though critics have long expressed doubts as to whether or not motivation is the problem.

“The only thing students want is to get a job and start a life here,” SFI instructor Annika Wall told the Dagens Nyheter newspaper last May.

“As I see things, this doesn’t solve any problems. Those who have difficulties and struggle for years aren’t going to be helped by the smartest students getting money."

For some students, the prospect of a bonus upon speedy completion of SFI classes did indeed serve as a motivating factor.

“It was my sole motivation in finishing the course in under a year," Australian Oliver Gee told The Local.

"I was in a position where I could benefit from finishing faster, and I knew I could do it, so I didn’t see why I wouldn’t take advantage of that.”

He added, however, that the bonus failed to motivate many of his fellow classmates.

“There were some people in my classes that knew they wouldn’t get the bonus and were not as efficient in learning the language so they disregarded the money and decided to take their time,” said Gee.

Though the bonus has been in place nationwide for a year, Ullenhag acknowledged that the effort is insufficient, saying it would be improved in the future.

“It is quite a new reform and we will evaluate it soon," he said.

He added that the bonuses were only part of a larger effort to improve SFI, which has long been viewed as a roadblock to immigrants' successful integration into Swedish society.

"We are also looking at incorporating a focus on better preparing immigrants for potential jobs when studying,” said Ullenhag.

He emphasised, however, that, in the eyes of the government, Swedish language education remains vital in immigrants' efforts to successfully establish themselves in Sweden.

“We are trying to put out a very clear message from society that one of the most important ways to integrate into the Swedish community is to learn the language,” he said.

Col Gaddafi 'offers talks on power transfer'


Fugitive Libyan leader Col Muammar Gaddafi is ready to begin talks to transfer power, US media has been told.

A spokesman told the Associated Press news agency negotiations would be led by Col Gaddafi's son, Saadi. He also said Col Gaddafi was still in Libya.

Rebels say desperately-needed fuel and water supplies should begin arriving in Tripoli on Sunday.

Meanwhile, more than 50 charred bodies have been found in a burnt-out warehouse south of Tripoli.

Residents of the district of Salah al-Din said they were civilians who had been executed on Tuesday by members of a brigade commanded by Col Gaddafi's son, Khamis, before they abandoned a nearby military base.

Human Rights Watch says it has evidence that pro-Gaddafi forces killed at least 17 prisoners and carried out "suspected arbitrary executions of dozens of civilians, including professionals" in the days before Tripoli fell to the rebels.

On Friday, more than 200 decomposing bodies were found at an abandoned hospital in the capital's Abu Salim district. Doctors and nurses fled because of the fighting and many injured patients were left to die.
'Sea of blood'
The Associated Press news agency in New York reported that it had received a call from Col Gaddafi's spokesman Moussa Ibrahim, who said the former leader was still in Libya although he did not specify where.
 
Analysis
He wouldn't be negotiating from any position of strength, except that the main reason for the shortage of water seems to be because pro-Gaddafi forces are still in control of the great man-made river water supplies in the south.
Any deal with Col Gaddafi would enable water to be returned to Tripoli, and there are other aspects of things that would improve if some sort of deal was made with him.
However, it is impossible to imagine that any deal - especially given the evidence of massacres that have come to light - would enable him to sit quietly in a private house in Tripoli.

Mr Ibrahim, whom AP says it identified by his voice, said Col Gaddafi had offered power transfer negotiations headed by his son, Saadi.

Early this week, CNN reported it had been in email contact with Saadi Gaddafi who confirmed his desire to negotiate a ceasefire.

"I will try to save my city Tripoli and 2 millions of people living there... otherwise Tripoli will be lost forever like Somalia," he wrote.

Without a cease-fire, Mr Gaddafi added, "Soon it will be a sea of blood."

Rebel fighters who now control most of the country, including the capital Tripoli, believe Col Gaddafi is still in hiding in the area.

The rebels' information minister, Mahmoud Shammam, said they were continuing to hunt for Col Gaddafi but it would not stop them from efforts to get the country back on its feet.

The focus has now moved to the urgent humanitarian situation in Tripoli, our correspondent says.

The opposition says it will start distributing 30,000 tonnes of petrol on Sunday, and provide cooking gas within the next 48 hours.

A ship carrying fresh water and diesel for the power stations is due to dock in the next couple of days.
Symbolic victory
Meanwhile, rebels are advancing towards one of the last sizeable pockets of pro-Gaddafi support in Libya - the town of Sirte.

The BBC's Clive Myrie in nearby Ras Lanuf says the fighters are making good progress, having taken the town of Bin Jawad, around 100km (62 miles) away, on Saturday afternoon.

Rebel commanders say negotiations are being held with Sirte's elders to try and force a peaceful surrender of the town, but so far those talks have gone nowhere.

The town sits in the middle of the main east-west coastal highway that runs across Libya and, until the rebels can take control of it, they cannot bring the two halves of the country together under their control.

Sirte is also Col Gaddafi's birthplace, meaning its fall would also be a huge symbolic victory for the rebel leadership, our correspondent says.

Katibu Mkuu Kiongozi Mstaafu, William Shelukindo, amesema Phillimone Luhanjo ameshindwa kumsaidia Rais Jakaya Kikwete.

Shelukindo ambaye alikuwa Naibu Katibu Mkuu wa Rais Ikulu (cheo ambacho sasa kinaitwa Katibu Mkuu Kiongozi) katika Serikali ya Awamu ya Kwanza ya Baba wa Taifa Mwalimu Julius Nyerere na Rais Ali Hassan Mwinyi, alisema Luhanjo ameonyesha utovu wa nidhamu na ameidhalilisha Ikulu kutangaza kumrejesha Jairo bila kupitia bungeni.

"Kwa kitendo cha kutangaza kupitia vyombo vya habari kumrejesha kazini Katibu Mkuu wa Wizara ya Nishati na Madini David Jairo badala ya kufikisha bungeni suala lake, amemdhalilisha Rais na Ikulu," alisema.

Akizungumza na Mwananchi Jumapili katika Mahojiano maalum, Shelukindo ambaye pia ni Mbunge wa zamani wa Jimbo la Bumbuli mkoani Tanga, alisema kuliruka Bunge ni kuchonganisha mihimili miwili yaani Serikali na Bunge.

"Sipendi kuzungumza hivi sasa kwa sababu nimeamua kukaa kimya, lakini kwa kuwa naheshimiana na vyombo vya habari na mmetaka nizungumzie suala hili, nasema Luhanjo amemdhalilisha Rais Jakaya Kikwete na alitaka kumchonganisha na mhimili muhimu wa Bunge," alisema Shellukindo.

Alisema Luhanjo amefanya makosa na kumfanya aonekane kwamba hajasoma katiba ya nchi, kwani inaeleza wazi kwamba bunge lina jukumu la kusimamia shughuli za Serikali kwani ni muhimili.

Shellukindo alisema ibara ya 63 kifungu kidogo cha kwanza ya katiba inasema bunge ni pamoja na Rais kwa sababu wote tumekwenda kwenye uchaguzi kuomba ridhaa ya wananchi ya kuongoza Serikali na ndiyo maana hata mawaziri wanatokana na wabunge.

Shellukindo alisema kitendo alichofanya Luhanjo kutoa taarifa ya kumrejesha Jairo kupitia vyombo vya habari pia kimemdhalilisha Waziri Mkuu, Mizengo Pinda.

Alisema kwa mujibu wa taratibu za kiutumishi serikalini, baada ya kupelekewa majibu ya uchunguzi juu ya Jairo, Luhanjo alistahili kuwasiliana na Rais Kikwete kutaka ushauri na Rais angewasiliana na Pinda ili aandae taratibu za kutangazwa bungeni na siyo kutangaza kupitia vyombo vya habari.

"Tatizo hapa Luhanjo aliharakisha mno kutangaza suala hili kupitia kwenye vyombo vya habari tena kwa mbwembwe kana kwamba alikuwa na dukuduku moyoni mwake la kuwaonyesha ubabe wabunge," alisema Shellukindo.

Kamati Teule
Spika wa Bunge, Anne Makinda juzi alitangaza majina ya wabunge watano, wanaounda Kamati Teule kuchunguza utaratibu uliotumiwa na Wizara ya Nishati na Madini, kukusanya fedha kutoka katika taasisi zilizopo chini ya wizara hiyo kwa ajili ya kufanikisha mchakato wa kupitisha wa bajeti.

Alisema kamati hiyo itakayofanya kazi kwa wiki zisizozidi nane pia itachunguza iwapo hatua ya Katibu Mkuu Kiongozi, Luhanjo, kutangaza matokeo ya uchunguzi dhidi ya Katibu Mkuu wa Wizara ya Nishati na Madini, David Jairo uliingilia haki na madaraka ya Bunge.

Hii ni kamati teule ya pili kuundwa wakati wa uongozi wa Rais Jakaya Kikwete, lakini kwa wizara hiyohiyo ya Nishati na Madini ambayo hivi sasa inaongozwa na Waziri William Ngeleja.

Kuhusu maadili ya utumishi kwa kipindi hiki akilinganisha na alipokuwa Ikulu, Shellukindo alisema nidhamu ya watumishi imeshuka na hili linaiweka pabaya Serikali ikiwamo kuvuja kwa baadhi ya siri za Serikali.

Alisema nidhamu katika utumishi imeshuka hivi sasa ikilinganishwa na wakati wa utawala wa awamu ya kwanza na ya pili, kwani watumishi walikuwa na uzalendo na nchi yao na ilikuwa ni jambo lisilowezekana kuona siri ya Serikali imevuja.

Alilipongeza bunge kwa kuunda kamati ya kuchunguza sakata hilo na kuwataka watumishi nchini kufanya kazi kwa nidhamu ili kusukuma mbele maendeleo ya nchi kwa kujivika uzalendo kwani utaalamu wao unahitajika kwa kiasi kikubwa.

Luhanjo
Jumanne wiki hii Ikulu ilitangaza kumrejesha kazini Jairo baada ya uchunguzi wa tuhuma dhidi yake za kutenga mamilioni ya shilingi kwa ajili ya kuhonga wabunge ili wapitishe bajeti ya wizara hiyo.

Luhanjo alitangaza uamuzi huo katika mkutano wake na waandishi uliofanyika Ikulu jijini Dar es Salaam akisema Jairo hana hatia na siku iliyofuata akatakiwa kurejea kazini.Hata hivyo, wabunge walichachamaa na kutaka kuundwa kwa kamati teule ya Bunge.

Kwa upande wake Jaji Mstaafu, John Mkwawa alisema kugongana kwa utendaji wa mihimili hiyo miwili ni jambo la kawaida na kuwataka wananchi kuzoea.
Jaji Mkwawa alisema kuwa hali hiyo ni ya kawaida hasa kwa nchi ambazo zina mfumo wa vyama vingi.
"Uamuzi huo ni wa kidemokrasia, lakini kikubwa ni hiyo Kamati Teule ya bunge kufanya kazi yake kwa umakini, haya ni mambo ambayo Watanzania wanatakiwa kuyakubali," alisema Jaji Mkwawa.
Alisisitiza kwamba Luhanjo naye ametumia madaraka yake kutokana na uamuzi alichukua huku akisisitiza kuwa hata uundwaji wa tume nao ni jambo ambalo lipo wazi.
"Tusiogope na kulipa jambo hili tafsiri mbaya wakati mwingine tukubali kuwa migogoro huwa ipo, ila lengo ni kufikia katika hatua nzuri," alisema Mkwawa.

At least 10 people have been killed in an apparent suicide car bombing at the UN building in the Nigerian capital Abuja.
The powerful blast wrecked the bottom floor of the building. Dozens have been injured, some critically.
A UN official in Nigeria, who spoke to the BBC on condition of anonymity, said the UN had received information last month that it could be targeted by Islamist group Boko Haram.
Security was stepped up in response.
A car bombing at police headquarters in June was blamed on Boko Haram, a group which wants the establishment of Sharia law in Nigeria.

Radical groups have targeted the Nigerian government many times before but this is the first attack on this scale against an international institution in Nigeria.
So far no-one has claimed responsibility for the blast. Nigeria is plagued with political rifts - some associated with the broad North-South Muslim-Christian divide.
A radical Islamic group known as Boko Haram - which roughly translated means "Western education is bad" - has attacked government buildings before.
But there are other disgruntled local groups including activists from the polluted oil-producing areas in the south-west. Any finger-pointing at this stage would be speculation.
There has been no claim of responsibility for Friday's attack, but government officials have blamed "terrorists" for the bombing, says the BBC's Bashir Sa'ad Abdullahi, who is at the site of the explosion.
Witnesses said the blast happened when a car rammed the front of the building after crashing through two security barriers.
Nigeria's Minister of State for Foreign Affairs, Viola Onwuliri, told the BBC she had visited the building and seen "the shock on people's faces".
"This is not an attack on Nigeria but on the global community," she said. "An attack on the world."
The building is the UN's main office in Nigeria, where all its agencies are based, the unnamed UN official told the BBC.
The official said security had been increased at all UN offices in Nigeria following the intelligence warning of a possible attack.
'Scattered bodies'
Friday's attack took place at about 1100 local time (1000 GMT) in the diplomatic zone in the centre of the city, close to the US embassy.

There was a loud explosion and smoke billowed from the building following Friday's powerful blast, which shattered all the glass in the building.
Our correspondent said the ground floor of the building was badly damaged and he saw the emergency services removing dead bodies from the building while a number of wounded were rushed to hospital.
One UN staff member said that people may still be trapped in the building, the AFP news agency reported.
"I saw scattered bodies," Michael Ofilaje, a Unicef worker at the building, said according to the Associated Press news agency (AP).
"Many people are dead."
He said it felt like "the blast came from the basement and shook the building".
Local hospitals are said to be overwhelmed with the number of injured and have appealed for blood donations.
Police have sealed off the area.

Pinda atangaza uamuzi wa Rais

"Je, pamoja na kuwa Bunge linazungumza, Serikali itakuwa tayari kuwachukulia hatua wote waliohusika na itakuwa tayari kutoa tamko kwamba, kitendo cha kukusanya fedha siyo utaratibu mzuri wa Serikali.’’

Akijibu swali hilo, Pinda alisema hawezi kulizungumzia zaidi jambo hilo na kwamba, ripoti itakayopelekwa bungeni na Kamati teule ndiyo itakayotoa maoni yake juu ya jambo hilo pamoja na kueleza nini kifanyike.“Siwezi kusema kitu chochote juu ya jambo hilo, lakini kamati itakayoundwa itatoa majibu na mapendekezo ya nini kifanyike ikiwa fedha hizo zilikuwa zikikusanywa kwa nia njema basi ni sawa, lakini kama ni kwa njia nyingine yoyote, basi hatua kamili zitachukuliwa,’’ alisema Pinda.

Kigwangala ajitosa
Mbunge wa Nzega, Dk Khamis Kigwangala (CCM), wakati akimuuliza swali Waziri Mkuu, alimtaka atoe majibu kuhusiana na jambo hilo ambalo alidai kuwa ana ushahidi wa kutosha kwamba, mbali na fedha zilizoelezwa hapo awali, Jairo alikuwa amefanya ufisadi mwingine.

“Mheshimiwa Waziri Mkuu, mbali na ile iliyozungumzwa hapo awali ninao uthibitisho kuwa sio fedha hizo tu, bali Jairo alifanya madudu mengine na vielelezo ninavyo hapa naweza kukupa ukitaka sasa hivi,’’ alidai Kigwangala.
Mbunge huyo alisema anavyo vielelezo, ambavyo ni pamoja na kinachoonyesha kuwa Jairo alichangisha Sh22 milioni na Sh5.8 milioni katika mazingira tofauti ambavyo alidai kuwa, ni kuonyesha ni namna gani Jairo alivyokuwa akitumia vibaya fedha za walipa kodi.

Hata hivyo, Pinda alisema kwamba, mambo yote hayo pamoja na vielelezo alivyovitoa Kigwangwala vitafanyiwa kazi na Tume itakayoundwa kabla ya kuahirishwa kwa Bunge leo ili vifanyiwe kazi kwa pamoja.
Kamati Teule ambayo itaundwa kufuatia hoja ya Mbunge wa Simanjiro (CCM), Christopher Ole Sendeka alipokuwa akichangia hoja ya awali iliyotolewa na Zitto, inatarajiwa kutangazwa leo na Spika wa Bunge, Anne Makinda.

Wizarani kwazizima
Katika Wizara ya Nishati na Madini, hali ilikuwa tulivu na gazeti hili lilifika katika ofisi ya Jairo haikumkuta mtu yeyote. Msaidizi wa Jairo, ambaye alijitambulisha kwa jina la Elias Kayandabila, alisema yeye siyo msemaji.

"Kila eneo lina utaratibu wake na mimi si mzungumzaji, hivyo ni vizuri muende kwa Tesha (Ofisa Uhusiano wa Wizara)," alisema.
Msemaji wa wizara hiyo, Alyoce Tesha, alisema kuwa Jairo aliomba likizo na aliyekuwa anakaimu nafasi hiyo wakati hayupo, Eliakimu Maswi, ataendelea kushikilia nafasi hiyo."Serikali ina utaratibu wake na makatibu wakuu wanasimamiwa na Katibu Mkuu Kiongozi, yeye ndiye anayejua atakuwa amempa likizo ya muda gani, hivyo kamuulizeni yeye," alisema Tesha.

NCCR yatoa neno
Kwa upande wake, Chama cha NCCR-Mageuzi kimesema kilichotokea kwa Jairo kinadhihirisha wazi kwamba mfumo mzima wa Serikali umechoka, haufai na ndiyo sababu ya kukithiri kwa ufisadi.

Akizungumza na waandishi wa habari jijini Dar es Salaam jana, Mwenyekiti wa chama hicho, James Mbatia, alisema: “Iweje Rais Kikwete atoe maamuzi mengine ya kumpa likizo Jairo huku akimwacha Luhanjo aliyemrudisha kazini?”
Mbatia aliongeza: “Aliyoyafanya Katibu Mkuu huyo ni kama tone moja la maji ndani ya bahari”.

Mbatia alisema kwamba, ndio maana sakata la Richmond aliyewajibika alikuwa aliyekuwa Waziri Mkuu, Edward Lowassa na si viongozi wengine.

Mbatia alifafanua majukumu ya mihimili ya Serikali akisema: “Serikali itatawala kwa kutekeleza sheria, Bunge litatunga sheria ili kuzifanya sera za nchi kutekelezeka na mahakama zitaamua mashauri na kutafsiri sheria na kutoa haki,”,
Mbatia alishangazwa na kauli ya Luhanjo kwamba, ni kawaida kwa wizara kuchangisha fedha kwa taasisi zilizo chini yake kwa ajili ya kuandaa na kupitisha bajeti.

“Tunataka wabunge wahoji kwamba, kwa nini hatuna kasma kwenye kila wizara ya kuandaa bajeti? Kwanini Katibu Mkuu awe anachangisha idara za wizara? Je, hakuna kiwango cha gharama za kuandaa bajeti,” alihoji Mbatia.
Alisema kama ni kweli imethibitika kwamba, fedha zilizochangishwa zilikuwa Sh578,599,100 ni wazi kuwa hoja ya wabunge imethibitika.

Mbatia alihoji zaidi akisema: “Kama ni hivyo Luhanjo alikuwa akichunguza nini?”.
Mbatia alisisitiza: “Hadidu za rejea za CAG zipanuliwe ili achunguze kama huo ndio utaratibu unaofuatwa na wizara zote… Luhanjo ametuhakikishia kuwa hilo ni sawa je, ni kweli na halali Serikali kutumia fedha za umma kifisadi kwa kisingizio cha kuandaa bajeti?”.

Alisema Bunge linatakiwa kufanya utafiti mpana ili kutambua ukweli jinsi watumishi wa wizara wanavyoandaa bajeti na kama ikibainika utaratibu unaotumika ni kama wa Jairo, itungwe sheria ya kuweka masharti mapya kuhusu jukumu hilo.

BUNGE jana lilisitisha kwa muda shughuli zake za kawaida kujadili hatua ya Katibu Mkuu Kiongozi, Philemon Luhanjo kumrejesha kazini Katibu Mkuu wa Wizara ya Nishati na Madini, David Jairo kabla ya Bunge kujadili Ripoti ya uchunguzi ya Mkaguzi na Mdhibiti Mkuu wa Hesabu za Serikali (CAG).

Hatua hiyo imekuja siku moja baada ya Luhanjo kukutana na waandishi wa habari Dar es Salaam juzi na kuutangazia umma kwamba kutokana na matokeo ya uchunguzi huo kutomtia hatiani anaamuru Jairo arejee ofisini mara moja.

“Kutokana na matokeo haya ya uchunguzi wa awali, mimi kama Mamlaka ya Nidhamu ya Katibu Mkuu Nishati na Madini, sitaweza kuendelea na hatua ya pili ya kumpa taarifa ya tuhuma. Ninaamuru David Jairo arejee kazini kuanzia siku ya Jumatano.”

Hata hivyo, uamuzi huo wa Luhanjo jana uliamsha hasira za wabunge bila kujali itikadi zao za kisiasa ambao ambao walitaka Bunge lisitishe kujadili shughuli zozote kutokana na hatua hiyo ya Katibu Mkuu Kiongozi wakisema ni kudharau Haki, Kinga na Madaraka ya Bunge.

Hoja ya Zitto
Hoja hiyo iliwasilishwa na Mbunge wa Kigoma Kaskazini (Chadema) muda mfupi kabla ya kuanza kwa kipindi cha maswali na majibu. Zitto ambaye pia ni Naibu Kiongozi wa Upinzani Bungeni alitoa hoja kutaka Bunge lisitishe kujadili hoja zote za Serikali hadi hapo ripoti ya Mkaguzi na Mdhibiti Mkuu wa Hesabu za Serikali iliyomsafisha Jairo itakapofikishwa bungeni na kujadiliwa.

Zitto alianzisha moto huo mnamo saa 3:17 asubuhi ikiwa ni dakika moja tu baada ya Naibu Spika, Job Ndugai kutangaza taratibu za safari ya wabunge kwenda Zanzibar kwa ajili ya mazishi ya Mbunge Mussa Khamis Silima aliyefariki juzi.

Alitumia kanuni ya 51 kulieleza Bunge kuwa kitendo kilichofanywa na Luhanjo kilikiuka haki, maadili na madaraka ya Bunge na hivyo akataka wabunge wenzake wamuunge mkono ili wagome kufanya shughuli zozote za Serikali hadi hapo ripoti ya CAG kuhusu tuhuma dhidi ya Jairo itakapowasilishwa rasmi bungeni.

“Mheshimiwa Naibu Spika, jana kupitia vyombo vya habari tulimsikia Katibu Mkuu Kiongozi kupitia vyombo vya habari akieleza kuwa tuhuma zilizokuwa zikimkabili Jairo si za kweli na kwamba anatakiwa kurudi kazini kuanzia leo (jana),’’ alisema Zitto na kuongeza:

“Mheshimiwa Naibu Spika unafahamu ya kwamba, Waziri Mkuu wa Jamhuri ya Muungano wa Tanzania alizungumza ndani ya Bunge hili ya kwamba angekuwa ni yeye angeshamchukulia hatua Ndugu Jairo kuhusu vitendo alivyofanya, hivyo basi naomba nitoe hoja kwamba Bunge lisitishe hoja yoyote ya Serikali mpaka itakapoleta bungeni taarifa ya CAG kuhusiana na uchunguzi huo.”

Baada ya kutoa hoja hiyo, Zitto aliungwa mkono na wabunge zaidi ya nusu waliokuwamo ndani ya ukumbi, hali ambayo ilimlazimisha Naibu Spika wa Bunge, Ndugai, kuitisha Kamati ya Uongozi kwa dharura kujadili suala hilo.
Hoja ya Lukuvi

Baada ya hoja ya Zitto, Waziri wa Nchi Ofisi ya Waziri Mkuu (Sera, Uratibu na Bunge), William Lukuvi alisimama kupinga hoja hiyo akisema Mbunge huyo hakufuata taratibu zilizotakiwa ambazo ni kuwasilisha kusudio kabla ya kutoa hoja rasmi.

“Mheshimiwa Naibu Spika, najua jambo hili lina public interest (masilahi ya umma), lakini kanuni zinasema kuwa mbunge anayetaka kuwasilisha jambo lolote linalohusiana na shughuli za Bunge atafanya hivyo wakati unaofaa na uliowekwa na kanuni na atakuwa amemwarifu Spika mapema kuhusu kusudio lake, hivyo ulitakiwa kuwasilishiwa mapema ili uweze kuamua,’’ alisema Lukuvi.

Akijibu hoja hiyo, Ndugai alisema: “Wakati nasoma matangazo mbalimbali kuhusiana na kifo cha Mbunge, nilipata taarifa kutoka kwa Zitto kuhusu kunitaarifu juu ya jambo hilo, hivyo basi, hoja iliyotolewa na Zitto imetolewa kwa wakati na ilifuata utaratibu unaotakiwa.’’

Uamuzi wa Kamati ya Uongozi
Baada ya kikao cha dharura cha Kamati ya Uongozi ya Bunge, ilipotimu saa 3:58, kabla ya kumalizika kwa maswali na majibu, Ndugai alirejea ukumbini na kutoa taarifa kuwa kikao hicho kiliongozwa Spika wa Bunge, Anne Makinda na kukubaliana na hoja ya Zitto.

“Kikao kilihudhuriwa na Spika wa Bunge, Anne Makinda na alikiendesha yeye mwenyewe. Kamati imepima hoja iliyotolewa na Zitto na kuona ni hoja inayohitaji kusikilizwa na Bunge na hakuna kipingamizi chochote,” alisema Ndugai na kushangiliwa kwa nguvu na wabunge.

Baada ya hapo Naibu Spika alimpa nafasi mtoa hoja, Zitto kuanza kujadili hoja hiyo na Mbunge huyo alisema jambo hilo lilikuwa ni la aibu kubwa mbele ya wabunge na taifa kwa ujumla.

“Jambo hili lilianzia bungeni na hivyo ripoti hiyo ilipaswa kuanzia humu bungeni. Kitendo cha Katibu Mkuu Kiongozi ni dharau kwa Bunge na kwa kuwa Waziri Mkuu alisema anamsubiri Rais, amemdharau na ninasema kama ningekuwa mimi ni Waziri Mkuu ningejiuzulu nafasi yangu mara moja,’ ’alisema Zitto.

Zainabu Vullu
Mbunge wa pili kuchangia hoja hiyo alikuwa Zainabu Vullu (Viti Maalumu - CCM), alisema kitendo hicho kinaudhi na kuwataka wabunge kuungana akisema madaraka yao yalikuwa yameingiliwa.

“Nianze kwa kuangalia Katiba kifungu namba 63 cha katiba Ibara ya Pili ambayo inasema sehemu ya pili ya Bunge itakuwa ndiyo chombo kikuu cha Jamhuri ya Muungano ambacho kitakuwa na madaraka kwa niaba ya wananchi kusimamia na kuishauri Serikali ya Jamhuri ya Muungano na vyombo vyake vyote katika utekelezaji wa majukumu yake kwa mujibu wa katiba,” alisema Vullu na kuongeza:

“Suala lile liliibuliwa ndani ya Bunge hili na baada ya kuibuliwa, Mheshimiwa Waziri Mkuu ambaye naye ni mbunge mwenzetu lilimgusa. Ni matarajio yetu baada ya utafiti na uchunguzi uliofanyika suala hili lingerudi kwetu tukalijadili na kuona nini kilichotokea na kuhabarisha wananchi wetu ni jinsi gani ya matumizi ya fedha za nchi hii ambazo jasho la wananchi zilivyotumika.”

Alisema kutokana na taarifa ya Luhanjo, bunge ni kama limedhalilishwa na kwamba halikupewa haki yake kwani wabunge wote wameonekana kama watu wasiojua wajibu wao.

Sendeka
Mjadala wa hoja hiyo ulihitimishwa na mchangiaji wa tatu, Mbunge wa Simanjiro (CCM), Christopher Ole Sendeka ambaye alikuja na hoja jingine ya kuomba Bunge lipitishe azimio la kuunda Kamati Teule kuchunguza suala hilo. Hoja hiyo, kama ilivyokuwa ile ya Zitto pia iliungwa mkono na wabunge karibu wote.

Sendeka alisema kitendo cha Luhanjo kutangaza ripoti hiyo ni kupoka nafasi ya Bunge na kwamba Waziri Mkuu amedharauliwa kwa kiasi kikubwa.

“Ninaomba kutumia kanuni ya 117 kuliomba Bunge lako tukufu sasa liamue kuunda kamati teule itakayoangalia pamoja na mambo mengine, kuingiliwa kwa uhuru wa Bunge, lakini mchakato mzima uliosababisha fedha zote zile zikusanywe na kugawanywa na kuitishwa kama fedha za harusi wakati tunajua kwamba kila waziri anapewa kasma ya maandalizi ya bajeti inayokuja,” alisema Sendeka na kuongeza:

“Wote (watumishi) waliokuja waliweza kuja na mafuta kutoka katika ofisi zao naomba Bunge hili, Mheshimiwa Naibu Spika liniunge mkono kwa kutoa hoja kwa mujibu wa kanuni ya 117, fasili ya kwanza ya pili mpaka ya nne ambayo inaweka masharti ya kuundwa kwa kamati teule na hii itasaidia sana kuitendea haki hoja hii na kulinda hadhi ya Bunge lako tukufu.”

Msimamo wa Bunge
Baada ya Sendeka kutoa hoja hiyo, Ndugai alisimama na kusema: “Sasa hoja hiyo Mheshimiwa Ole - Sendeka ameiboresha kwa kutoa hoja ya kuunda tume teule ambayo waheshimiwa wabunge mmeiunga mkono kwa wingi sana kwa kutumia kanuni ya 117 ambayo inasema kamati teule inaweza kuundwa na Bunge kwa madhumuni maalumu kwa hoja mahsusi itakayotolewa na kuafikiwa.”

“Mimi ninakubaliana na jambo hili na kwa jinsi hiyo, kufuatana na kanuni hiyo ya 117 Bunge hili litaunda tume teule kwa ajili ya kulichunguza jambo hili kwa sababu Bunge ni mhimili, haliwezi kudharaulika kiraisi na tunaiheshimu na kuipenda sana Serikali yetu inayoongozwa na Mheshimiwa Rais Jakaya Kikwete na Waziri mkuu wake Mizengo Pinda.”

“Si rahisi kwa Bunge kuonekana Waziri Mkuu akidharaulika likanyamaza! Haiwezekani, kama dharau inaweza kutokea hukohuko si ndani ya Bunge hili.”

Baada ya uamuzi huo, Mbunge wa Musoma Vijijini (CCM), Nimrod Mkono alijaribu kupinga uamuzi huo akitaka jambo hilo liende kwa utaratibu ili Bunge lisije likaingilia taratibu za mihimili mingine. Alihoji kwa kitendo cha kutompatia nafasi Jairo ili ajieleze lakini Ndugai alisema jambo hilo alishalifunga lakini akamtoa shaka mbunge kuhusu haki: “Kama ni kuhojiwa basi ataitwa akahojiwe huko asipotendewa haki hiyo utaleta hoja yako.’.
Jairo apokewa kishujaa

Wakati wabunge wakimng'ang'ania, Jairo alipokewa kwa mbwembwe aliporipoti ofisini kwake Dar es Salaam huku baadhi ya wafanyakazi wakisukuma gari lake na kuimba: “Baba, baba baba huyooo, karibu baba, karibu baba, umeshinda vita karibu nyumbani.’

Akizungumza baada ya kuingia ofisini, Jairo alisema: “Nimesamehe kwa upendo mkubwa. Siwezi kulipiza kisasi, wala sitachukua hatua zozote kwa kuwa mimi ni Mkristo nimerudi kwa amani, tuchape kazi tujenge nidhamu,” alisema.

Mara baada ya kufika ofisini kwake, Jairo akionekana mwenye uso uliojaa furaha huku akilengwa na machozi alisimama mbele ya kiti chake akiwa kimya akitazama chini na kisha alitoka na kuelekea ofisini kwa Waziri wake, William Ngeleja.

“Nimejipanga kuchapa kazi kwa bidii na kudumisha ushirikiano uliokuwapo tangu awali, nashukuru haki imetendeka na sitawashtaki wale walionituhumu,’’ alisema Jairo na kuongeza kwamba watu wajielekeze kwenye mambo ya maendeleo kuliko kufuatilia mtu mmojammoja, kwa kuingiza maslahi binafsi.

Waziri Ngeleja alisema ameshukuru kwamba Jairo amerudi baada ya misukosuko ya hapa na pale.


LHRC wapinga
Kituo cha Sheria na Haki za Binadamu (LHRC) kimepinga hatua ya Serikali kumsafisha Jairo na kisha kumtaka arejee kazini, kikisema hatua hiyo imedhalilisha Bunge.
“Taarifa ya kusafishwa kwa Jairo inaashiria mambo matatu, kwanza inaonyesha kuna mkakati wa kuwalinda viongozi pale wanapofanya makosa. Pili, taarifa hiyo imelidhalilisha Bunge ambalo ndilo lilifichua kashfa hiyo, Beatrice Shelukindo ndiye aliyefichua hayo. Tatu, taarifa hiyo imemdhalilisha Waziri Mkuu na kumfanya aonekane kutokuwa makini na kauli zake hasa pale aliposema kuwa angeweza kumchukulia hatua Jairo lakini anasubiri taarifa ya Rais.”

Policy Forum yakosoa
Mratibu asasi ya kiraia ya Policy Forum, Semkae Kilonzo alisema Serikali imechukua uamuzi huo bila ya kuzingatia uzito wa jambo husika. Alisema umefika wakati iache kufanya kazi kwa mazoea na iheshimu mamlaka ya mihimili mingine.

Alisema Katiba ya sasa katika Ibara ya 63, kifungu kidogo cha 1 hadi 3 inaeleza bayana, mamlaka ya Bunge na kusisitiza kuna haja ya mhimili huo kupewa meno zaidi kwa mujibu wa sheria ili ushauri na maoni yake yaweze kutekelezeka.

“Wabunge walishaeleza maoni yao kuhusu sakata hilo lakini serikali imechukua hatua bila ya kuzingatia uzito wa jambo lenyewe, cha msingi hapa ni bunge liongezewe meno zaidi ili kazi zake ziweze kuheshimika na kutekelezeka,” alisema Kilonzo.

    The man who could expose Britain’s tangled relationship with Colonel Gaddafi embarrassed Nato allies as he made a dramatic return to the heart of Tripoli last night.
    The appearance of Libyan leader’s son Saif al-Islam, at the hotel used by foreign journalists, made a mockery of claims by rebel forces and the International Criminal Court that he had been captured.
    The 39-year-old, second eldest of the dictator's sons, said the rebels had been drawn into a trap, loyalists could still win the war and that his father was alive somewhere in the city.
    Wearing casual clothes and looking relaxed and confident, Saif beamed as he reached out to touch hands in the crowd and declared: ‘To hell with ICC.’
    It is not clear if Saif had been captured and escaped, been freed or had never actually been in custody at all.
    And as fighting continued on the ground today outside the compound where Gaddafi is accused of 'hiding like a rat', the rebels' claim to have captured a huge percentage of Tripoli was beginning to look rather dubious.
    Meanwhile, there is a potential crisis looming at the last hospital operating in the city, which is overrun with wounded patients and running out of doctors and equipment.

    Heavy fighting is taking place in Tripoli around the compound of embattled Libyan leader Col Muammar Gaddafi after rebels seized control of much of the city on Sunday.
    Throughout the night, jubilant crowds remained in central Green Square, previously the scene of nightly pro-Gaddafi demonstrations.
    Rebels met little resistance as they swept in from east, south and west.
    A rebel spokesman says pro-Gaddafi forces still control 15-20% of Tripoli.
    The rebels also said they had captured Col Gaddafi's son Saif al-Islam, but there is no word of the colonel's whereabouts.
    Tanks emerged from Col Gaddafi's Bab al-Azizia compound early on Monday morning and began firing, a rebel spokesman said.
    Sustained gunfire has been heard in the area.
    Western leaders have welcomed the rebel advance and urged Col Gaddafi to go.

    The hotel where we and other foreign journalists are staying is still under the control of pro-Gaddafi guards, and we believe that they are now preparing to defend it from opposition forces.
    There's been an awful lot of firing going on in recent hours in the area.
    We believe there will some sort of rebel attempt to take the hotel because it's the place from which the Libyan information minister has been broadcasting his take on the conflict - it's also the place from where Libyan TV has recently been broadcasting its nightly shows from.
    So it's one of the targets of the opposition forces. What's happening here is in sharp contrast to what's happening three miles - or 5km - down the road in Green Square, where there are jubilant scenes.
    The BBC's Tripoli correspondent, Rana Jawad, who has been unable to report openly since March, says people in her neighbourhood in eastern Tripoli were woken by the imam at the local mosque singing the national anthem of the pre-Gaddafi monarchy.
    There is very much a sense that the end is near and the rebels have achieved what they wanted, our correspondent says.
    In Green Square - which is to return to its original name of Martyrs' Square - rebel supporters tore down the green flags of the Libyan government and trampled on portraits of Colonel Gaddafi.
    "Tonight, the momentum against the Gaddafi regime has reached a tipping point. Tripoli is slipping from the grasp of a tyrant," said US President Barack Obama in a statement.
    UK Prime Minister David Cameron, who is cutting short his holiday to chair a meeting of the National Security Council, said it was clear "that the end is near for Gaddafi".
    Mr Cameron said the Libyan leader had "committed appalling crimes against the people of Libya and he must go now to avoid any further suffering for his own people".
    The International Criminal Court (ICC) has issued arrest warrants for Col Gaddafi, his son Saif al-Islam, and the head of the intelligence service, Abdullah al-Sanussi, for crimes against humanity. ICC prosecutor Luis Moreno Ocampo said he had been informed of Saif al-Islam's arrest.
    Another of Col Gaddafi's sons, Muhammad, was speaking on the phone to al-Jazeera TV when he said the rebels were surrounding his home. Gunfire was heard before the line cut off.
    A diplomatic source told the AFP news agency that Col Gaddafi could still be in Bab al-Azizia. He has not been seen in public since May, although he has broadcast audio messages from undisclosed locations.
    TV footage showed Libyans kneeling and kissing the ground in gratitude for what some called a "blessed day".
    'Pockets of resistance'

    In an audio message broadcast late on Sunday, the Libyan leader urged residents to "save Tripoli" from the rebels.
    "How come you allow Tripoli, the capital, to be under occupation once again?" he asked. "The traitors are paving the way for the occupation forces to be deployed in Tripoli."
    Libyan Information Minister Moussa Ibrahim told CNN that the Gaddafi government still had 65,000 loyal soldiers under its command.
    However, some forces have surrendered to the rebels, including the special battalion charged with securing Tripoli.
    The chairman of the rebel National Transitional Council (NTC) Mustafa Mohammed Abdul Jalil said early on Monday: "I warn you, there are still pockets of resistance in and around Tripoli."
    Mr Ibrahim said fighting in the city since noon (10:00 GMT) on Sunday had left 1,300 people dead and 5,000 wounded. There is no confirmation of the figures.

    During the day, one group of rebels had pushed in from the west while another set up checkpoints on the eastern outskirts.
    It is clear there have been bloody battles in parts of Tripoli, the BBC's Matthew Price reports from the city.
    The Libyan information minister accused Nato of backing "armed gangs" with air power. He added that the Gaddafi government was prepared to negotiate directly with the NTC.
    Mr Jalil said the rebels would halt their offensive if Col Gaddafi announced his departure.
    Speaking about Saif al-Islam Gaddafi's capture, Mr Jalil said he was "being kept in a secure place under close guard until he is handed over to the judiciary".
    He added that rebel forces would give Col Gaddafi and his sons safe passage out of the country.
